Vybe Terms and Conditions

These Terms and Conditions (“Terms”) govern your use of the Vybe mobile app, vybeapp.fit, and related services (together, the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use Vybe. If you are under the age of legal majority where you live, you may use Vybe only with permission from a parent or legal guardian. Do not use the Service if applicable law prohibits you from doing so.

2. Accounts

Provide accurate account information, keep it current, and safeguard your password and authentication codes. You are responsible for activity through your account unless caused by Vybe’s failure to use reasonable safeguards. Use the private support form promptly if you believe your account has been accessed without permission. You may not sell, transfer, or impersonate another person’s account.

3. User content and permissions

You retain ownership of posts, messages, photos, videos, workout or nutrition information, and other content you submit (“User Content”). You are responsible for your User Content and must have the rights and permissions needed to submit it.

You grant Vybe a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, transmit, display, and distribute your User Content only as needed to operate, secure, improve, and provide the Service according to your settings and actions. This license includes allowing service providers to process content on Vybe’s behalf. It ends when the content is deleted from active systems, except where limited retention is required by law, safety, dispute, or backup obligations, or where another user has independently copied or shared the content.

Vybe may remove or limit access to User Content that violates these Terms, applicable law, or the rights or safety of others. We do not endorse User Content and cannot guarantee that all content is accurate or appropriate.

4. Acceptable conduct

You may not use the Service to:

  • break the law, facilitate harm, or violate another person’s rights;
  • harass, threaten, exploit, discriminate against, or impersonate others;
  • share unlawful, deceptive, hateful, sexually exploitative, or privacy-invasive content;
  • target, groom, or endanger a minor;
  • send spam, manipulate engagement, or collect user information without permission;
  • introduce malware, probe security, bypass access controls, disrupt the Service, or access another account without authorization; or
  • use automated scraping or extraction in a way that burdens the Service or violates law or another person’s rights.

You may report suspected abuse through available in-app tools or the private support form.

5. Health, fitness, and location disclaimer

Vybe is not a medical service. Workouts, fitness information, nutrition content, health goals, and other content on Vybe are for general informational and social purposes. They are not medical advice, diagnosis, or treatment and are not a substitute for a qualified professional. Consult an appropriate healthcare professional before beginning or changing an exercise, diet, or health program, especially if you have symptoms, an injury, a medical condition, are pregnant, or take medication. Stop activity if you feel pain, faintness, or illness, and contact local emergency services in an emergency.

You are responsible for deciding whether an activity is appropriate for you and for using equipment, facilities, routes, and gym information safely. Locations, business details, and user-provided information may be incomplete, outdated, or inaccurate.

6. Third-party services

Vybe may integrate with or link to services operated by others, including sign-in, maps, messaging, media storage, and notification providers. Their terms and policies govern your use of their services. Vybe is not responsible for third-party services or content that it does not control.

7. Service availability and changes

We may maintain, update, add, remove, suspend, or discontinue Service features. We aim to keep Vybe reliable, but we do not promise uninterrupted, error-free, or permanently available service. Features may vary by device, location, account status, or third-party availability.

8. Suspension, termination, and deletion

You may stop using Vybe at any time and may delete your account through the in-app control described on the Account Deletion page. Vybe may restrict, suspend, or terminate access when reasonably necessary to address a Terms violation, fraud, security or safety risk, legal requirement, or material harm to the Service or others. Where appropriate, we may provide notice or an opportunity to appeal.

Terms that by their nature should survive account termination remain effective, including provisions about licenses needed for limited retention, disclaimers, liability, and governing law.

9. Disclaimers and liability

To the fullest extent permitted by law, the Service is provided “as is” and “as available,” without implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Vybe does not warrant User Content, fitness or nutrition results, gym information, or third-party services.

To the fullest extent permitted by law, Vybe is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or opportunities arising from use of or inability to use the Service. Vybe’s liability for claims that cannot lawfully be excluded is limited to the maximum extent permitted by applicable law. These limitations do not exclude liability or consumer rights that applicable law does not allow us to exclude or limit.

10. Changes to these Terms

We may update these Terms as the Service or law changes. We will post the revised Terms with a new effective date and provide additional notice in the app or by email when required. If you do not agree to revised Terms, stop using the Service and delete your account. Continued use after the revised Terms take effect means you accept them where permitted by law.

11. Governing law

These Terms are governed by the laws of the Commonwealth of Pennsylvania and applicable United States federal law, without regard to conflict-of-law rules. This section does not deprive you of non-waivable protections or rights available under the law where you live.
